Nondisclosure of some immaterial facts would recess the right to information, but it is further determined that the fundamental privilege has also been hurt by some deceptive practices. Where a beneficial amount of facts are actively concealed and fraudulently defected in title. The active concealment of information with the intention of doing performing it or doing any such act fitted to deceive. This practice also hurt the fundamental constitutional privilege, when any conducive amount of information actively concealed. The silence of facts would not be constituted in a wrongful manner unless the defendant is under an obligation to talk and conceal the facts of a particular process or recruitment of faculty member in teaching institution. Therefore, in compliance with the Governor Punjab’s order number No.GS(Univ-I)11-5/2017-25 dated October 28, 2021; date of Hearing: 16.09.2021 the syndicate of the University of Sargodha in its 1/2022 meeting held on 27.09.2022 constituted a committee to investigate the illegal recruitment process of appointment of Dr. Sajid Bashir as Professor of Pharmacy (BS-21). The notification No. SU/Admin(HR) 6464-74 dated November 7, 2022 issued successfully. A third party unbiased examination of facts is necessary to establish the rule of law and enforce proper recruitment standards. For this purpose, the governor house, provincial education department and local accountability authorities have to play key role to rectify and correct the system and establish the rule of law in public sector universities in Pakistan.
